Sell My House with Liens

The short answer.

Unpaid taxes, contractor bills, association dues, and court judgments become liens on the property in every state: Florida tax certificates accrue up to 18% a year, Ohio judgment liens attach through a certificate of judgment under R.C. 2329.02, and Michigan routes tax debt to the county treasurer. A title search finds every lien; each is paid from proceeds at closing.

§03

Liens in Broward County.

Liens in Broward County come in several forms. Property tax liens are filed by the Broward County Tax Collector for unpaid property taxes; under Florida Statutes § 197.172 the delinquency accrues 18% interest a year until a tax certificate sells (with a 3% minimum charge if paid before the sale), and the certificate itself can earn up to 18% a year. Mechanics liens are filed by contractors for unpaid work; under Florida Statutes Chapter 713 the claim must be recorded within 90 days of the last labor or materials. HOA liens are filed by associations for unpaid dues or assessments. Judgment liens are filed by creditors and under § 55.10 attach to real property for up to 10 years, renewable once for another 10. A title search reveals all liens. InTym Properties pays them from the sale proceeds at closing; you don't need to pay them out of pocket. If the liens exceed the property value, we discuss options honestly, including short sale referrals.

Tax and certificate interest at 18% a year: Florida Statutes § 197.172.

Contractor lien deadlines: Florida Statutes Chapter 713.

Judgment liens at ten years, renewable once: Florida Statutes § 55.10.

§03.5

Liens in Idaho.

Idaho carries the same lien types, with different mechanics, and the property tax lien bites harder here. Under Idaho Code § 63-1001 a tax delinquency acts as a sale of the property to the county tax collector in trust, accruing interest at 1% per month; under § 63-1005, if the delinquency isn't redeemed within three years the county must issue a tax deed, after certified-mail notice to the record owner and parties in interest. Ada, Canyon, Twin Falls and Bonneville counties all run this process. Mechanics liens work the other way (weaker than Florida's). A contractor must record the claim with the county recorder within 90 days of the last labor or materials under § 45-507, and under § 45-510 the lien dies six months after filing unless the claimant sues to enforce it, so a recorded mechanics lien isn't necessarily a live one. Judgment liens are created by recording a certified abstract of the judgment with the county recorder under § 10-1110; the lien then attaches to all non-exempt real property the debtor owns in that county for ten years from the judgment date. State tax liens are different again: the Idaho State Tax Commission records its notice of lien with the Secretary of State under Title 45, Chapter 19, and it attaches to all property you own in Idaho, not just the parcel you're selling. Condo and HOA assessment liens come from the recorded declaration (for condominiums, § 55-1518) makes unpaid assessments a lien once notice is recorded. A title search surfaces all of them. InTym Properties pays them from the sale proceeds at closing; you don't pay out of pocket. If the liens exceed the value, we discuss options honestly, including short sale referrals.

§03.6

Liens in Ohio.

Same lien categories, Ohio mechanics. Mechanics liens: a contractor records an affidavit with the county recorder, within sixty days of the last work for a one- or two-family dwelling or condo unit, seventy-five days for other projects, under R.C. 1311.06, and the lien stays in force six years unless enforced sooner under R.C. 1311.13. Judgment liens: under R.C. 2329.02 a creditor files a certificate of judgment with the clerk of the court of common pleas, and the lien attaches to the debtor's real property in that county; the underlying judgment goes dormant after five years if it is not revived, but dormant is not dead for closing purposes. Property tax debt is the dangerous one: it is a first lien, and unpaid taxes feed either a tax-certificate sale or a county tax foreclosure under Chapter 5721. HOA assessment liens and municipal special assessments ride the recorded documents. A title search surfaces all of it; InTym Properties pays the liens from the sale proceeds at closing through a licensed Ohio title company. You do not pay out of pocket.

§03.7

Liens in Michigan.

Michigan runs a quieter lien system with one hard exception. Construction liens: under the Construction Lien Act a contractor, subcontractor, or supplier must record the claim of lien with the county register of deeds within ninety days of the last furnishing of labor or material, MCL 570.1111, and must enforce it in circuit court within a year or it dies, so an old recorded lien may already be unenforceable. Judgment liens: a creditor records a notice of judgment lien with the register of deeds under MCL 600.2803, and it attaches to the debtor's real property in that county for five years. The exception is property taxes: Michigan sells no private tax certificates. Delinquent taxes go to the county treasurer and run through the forfeiture-and-foreclosure statute, MCL 211.78a and following sections, a longer runway than Florida's certificate clock but an absolute end: the foreclosure judgment vests title in the county. A title search surfaces all of it; InTym Properties pays the liens from the sale proceeds at closing.

§04
“Liens compound: interest accrues, new liens stack on old ones. InTym Properties stops the compounding at closing.”

§05

Questions.

Can I sell a house with liens in Broward County?

Yes. Liens are paid from the sale proceeds at closing. You don't need to pay them out of pocket. The title company handles the payoff and releases the liens.

What types of liens can you handle?

Tax liens (property and IRS), mechanics liens, HOA liens, judgment liens, code enforcement liens, and mortgage liens. InTym Properties handles all types.

What if the liens are more than the house is worth?

If liens exceed the property value, a short sale may be your best option. InTym Properties discusses this honestly and can refer you to a local attorney who handles short sales.

How does the lien payoff work at closing?

The title company conducts a title search, identifies all liens, and pays them from the sale proceeds at closing. You receive the remaining balance. Every line item is shown in writing before you sign.

Will I get less money because of the liens?

The offer reflects the lien amounts. InTym Properties shows you the math: the offer price minus lien payoffs equals your net. Everything is in writing before you sign.

How fast can you close on a house with liens?

As soon as 7 days if the title search is clear (no additional liens discovered). Complex lien situations may take longer. InTym Properties handles the entire process.

How do I find out what liens are on my Broward County property?

A title search finds all of them, and you can look yourself first: the Broward County official records are searchable by name and show recorded mortgages, liens, judgments, and code enforcement actions, while delinquent property taxes appear on the county's tax roll. InTym Properties pulls the county records before writing the offer, so nothing surfaces after you sign.

How do mechanics liens work in Ohio?

The contractor records an affidavit with the county recorder, within 60 days of the last work on a one- or two-family dwelling or condo unit and 75 days for other projects, under R.C. 1311.06, and the lien stays in force six years under R.C. 1311.13. A title search surfaces it and it is paid from proceeds at closing.

How do construction liens work in Michigan?

Under the Construction Lien Act a contractor records the claim of lien with the county register of deeds within 90 days of the last furnishing of labor or material, MCL 570.1111, and must enforce it within a year or it dies. Judgment liens attach for five years by recorded notice under MCL 600.2803. A title search surfaces both.
